These terms apply to all users of our services, including those who subscribe to our monthly plans for UX/UI design, website development, hosting, domain registration, SSL certificates, and ongoing support.

Please read these Terms and Conditions carefully before subscribing to or using our services. If you do not agree with any part of these terms, you must not use our services.

1. Definitions

• “Service” refers to the Website-as-a-Service platform provided by Cool Design Hub (owned and operated by Alex Nunez Labarca), including UX/UI design, website development, hosting, domain registration, SSL certificates, SEO, and monthly support.
• “User” or “Customer” refers to the individual or entity subscribing to our Service.
• “Subscription” refers to the payment plan chosen by the User, billed on a recurring monthly basis.
• “Website” refers to the site that we develop and maintain for the User as part of the Service.

2. Service Description

Cool Design Hub (owned and operated by Alex Nunez Labarca), offers an all-in-one website solution on a subscription basis, which includes:

• UI/UX Design: Professional and user-friendly interface design.
• Website Development: Custom website design and development tailored to the User’s needs.
• Hosting: Secure and reliable web hosting for the User’s website.
• Domain Registration: Domain name registration and renewal (.com, .net, .org, or any regular price domain, no premium domains).
• SSL Certificate: SSL encryption to secure the User’s website.
• Monthly Support: Ongoing updates, technical support, and maintenance.

3. Subscription Plans and Payments

We offer multiple subscription plans, each with varying features and pricing. By subscribing to a plan, you agree to the following:

• Your chosen subscription will automatically renew on a monthly basis until canceled.
• Subscription fees are clearly stated on our pricing page and may vary depending on the plan you choose (Small, Medium, Large, ExtraLarge).
• After two (2) years of a continuous  active plan, and per request of the “customer”, we will offer a redesign of the entire website at no cost.
• All plans are subject to a one (1) year commitment, to cover the cost of Domain registration and UX/UI design rights.
• All UX/UI designs provided within the first year of any plan service are owned and is the property of Cool Design Hub (owned and operated by Alex Nunez Labarca), until the start of the second year, at this point, all the design rights will be moved to the “Customer”. (Refer to 7. Intellectual Property)

• Subscription fees are charged monthly, in advance, on the anniversary of your subscription date.
• You agree to provide accurate and complete billing information, including a valid payment method. We accept major credit cards through Paypal.
• If payment is not received or cannot be processed, your access to the Service may be suspended or terminated until the issue is resolved.

Cool Design Hub (owned and operated by Alex Nunez Labarca), reserves the right to modify subscription fees at any time. If a price change occurs, we will notify you at least 30 days in advance, and the new pricing will take effect in the next billing cycle.

4. Data Security

• You may cancel your subscription at any time by contacting our support team.
• If you cancel the subscription at the end of the first year, your domain can be moved to another provider and the website can be exported and sent via a secure link without any restrictions; Although, If you cancel before the first year, the domain cannot be moved to another provider after this period passes. Also, the website cannot be exported or moved to another provider as a penalty (refer to 3. Subscription Plans and Payments, a. Subscription Plans).
• Cancellation will take effect at the end of your current billing cycle.
• After cancellation, your website will remain active until the end of your paid billing period. No refunds will be provided for any unused portion of the subscription.

We reserve the right to terminate or suspend your account at our discretion for the following reasons:

• Failure to comply with these Terms and Conditions.
• Non-payment of fees.
• Misuse of our services or violations of applicable laws.

5. Refund Policy

There are only two scenarios for refunds:

We offer a money-back guarantee for 30 days from the day you purchase your website. If you are not happy for any reason, just contact us for a refund.

The domain registration service will be deducted from the refund total. If you are not happy for any reason, just contact us for a refund.

6. User Responsibilities

By using our Service, you agree to the following:

• Content Ownership: You are responsible for all content (text, images, videos, etc.) published on your website. You must ensure that your content complies with all applicable laws and does not infringe on the rights of third parties.
• Lawful Use: You may not use our Service for illegal activities, including but not limited to fraud, spamming, distributing malware, or violating intellectual property rights.
• Accurate Information: You must provide accurate, current, and complete information when registering for and maintaining your account.

7. Intellectual Property

While we design and build your website, you retain ownership of all content and intellectual property that you provide to us. However, Cool Design Hub (owned and operated by Alex Nunez Labarca), retains ownership of the UX/UI design, code, and underlying infrastructure of the website until all applicable subscription fees have been paid from year one (1).

During the subscription period, we grant you a limited, non-exclusive, and non-transferable license to use the website for your business or personal purposes. This license is contingent on compliance with these Terms and Conditions.

8. Data Privacy and Security

Your privacy is important to us. We collect and process personal data in accordance with our Privacy Policy. By using our Service, you consent to the collection and use of your information as described in our Privacy Policy.
We implement industry-standard security measures to protect your data; however, no method of transmission over the internet is 100% secure. You acknowledge that you use the Service at your own risk.

9. Limitation of Liability

To the fullest extent permitted by law, Cool Design Hub (owned and operated by Alex Nunez Labarca), and its affiliates will not be liable for any direct, indirect, incidental, special, consequential, or punitive damages resulting from:

• Your use or inability to use the Service.
• Any interruptions, errors, or security breaches.
• Loss of profits, data, or goodwill.

Our liability in any event is limited to the amount you paid us in the 12 months preceding the incident giving rise to the liability.

10. Indemnification

You agree to indemnify, defend, and hold harmless Cool Design Hub (owned and operated by Alex Nunez Labarca), from any claims, liabilities, damages, losses, or expenses arising out of your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

11. Changes to Terms and Conditions

Cool Design Hub (owned and operated by Alex Nunez Labarca), reserves the right to modify these Terms and Conditions at any time. If changes are made, we will notify you by email or by posting a notice on our website. Your continued use of the Service after the effective date of the revised terms constitutes your acceptance of the changes.
